Terms of Service

1. The Service
Smooth provides a business inbox for managing customer emails, AI-powered insights on messages, notification capabilities, secure file uploads for chat history, and subscription-based premium features. We may modify or discontinue features with reasonable notice.
2. Eligibility and Accounts
You must be at least 16 years old and capable of entering binding contracts. Registration information must be accurate and kept current. You are responsible for protecting your credentials and all account activities.
3. Subscriptions and Billing
Certain features require paid subscriptions. Prices and billing periods appear in-app. App stores or subscription providers may process payments. Taxes may apply. Failed payments can result in suspended access. Fees are generally non-refundable except where required by law or platform policy.
4. Your Content and License
You retain ownership of your content, including emails and uploads. You grant us a worldwide, non-exclusive license to host, store, process, transmit, display, and create derivative works necessary for service delivery, security, and improvement.
5. Acceptable Use
You may not:
- Violate any laws or regulations
- Infringe on the rights of others
- Upload harmful or malicious content
- Access accounts without authorization
- Interfere with service infrastructure
- Circumvent security measures
- Send spam or unsolicited messages
- Reverse engineer any component of the Service
Violations may result in account suspension or termination.
6. AI Features and Responsibility
AI outputs are recommendations only. You are responsible for reviewing them before use and should not treat them as legal, medical, or professional advice. You must ensure your content is accurate and legal.
7. Third-Party Services
The Service integrates with third-party providers. Their terms may apply separately. We are not responsible for third-party services outside our control.
8. Privacy
Your use of the Service is subject to our Privacy Policy. You consent to information collection as described there.
9. Service Availability and Support
We strive for high availability but do not guarantee uninterrupted or error-free operation. Maintenance or incidents may cause temporary unavailability. Support is provided via smooth@app.smooth.biz.
10. Intellectual Property
The Service, software, branding, and design are owned by us or our licensors. We reserve all rights not expressly granted to you.
11. Feedback
You grant us a royalty-free, worldwide, transferable, sublicensable license to use and incorporate any feedback without restriction.
12. Termination
You may stop using the Service or request account deletion at any time. We may suspend or terminate access for breach, legal compliance, risk, or non-payment. Upon termination, your usage rights cease.
13. Disclaimers
The Service is provided “as is” and “as available.” All warranties are disclaimed, including merchantability and fitness for particular purposes. We do not warrant uninterrupted, secure, or error-free operation.
14. Limitation of Liability
We are not liable for indirect, incidental, special, consequential, or punitive damages. Our aggregate liability is limited to amounts you have paid us in the preceding 12 months.
15. Indemnification
You indemnify us against claims, liabilities, damages, and expenses arising from your content, use of the Service, or violation of these Terms.
16. Export and Sanctions
You must comply with all applicable export control and sanctions laws.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of England and Wales. The courts of London have exclusive jurisdiction except where consumer law provides mandatory local jurisdiction.
18. Changes to These Terms
We may update these Terms to reflect legal, feature, or practice changes. Material changes will receive notice. Continued use after updates constitutes acceptance.
